Terms of Use

In short
Proof is free. You keep ownership of your content; you grant us the rights needed to run the service and to derive statistics from it. A shot is taken on site, the community guidelines apply, and an account deletes in two taps from Settings. The app is for ages 15 and up.
This summary has no contractual value: only the full text binds.
1. Purpose and acceptance
These terms govern access to and use of proofplaces.com and the Proof app, published by Proof., a French SAS registered in Paris under number 105 827 075, headquartered at 47 rue Vivienne, 75002 Paris ("Proof", "we"). Using the site means accepting the sections that concern it. Creating an account in the app means accepting the whole text, including the community guidelines, which are an integral part of it. The accepted version and its date are stored with the account, and the current version remains available at any time from the app and this page.
2. Minimum age
The service is for people aged 15 and over. Sign-up refuses any date of birth under that threshold, and an account created on a false declaration is deleted on detection. Details on our child safety page.
3. The account
One account per person, created with accurate information and a phone number verified by SMS (any cost of the received SMS depends on your carrier; Proof charges nothing). You are responsible for what happens from your account and you alert us without delay at support@proofplaces.com if you believe it is compromised. Credentials are not lent, sold or exchanged.
4. The shot, the rule of the game
Proof rests on one promise: a review is a shot taken on site, the moment you are there. The app measures the distance between the device and the place at publication time; a shot taken nearby is marked verified, a shot taken remotely still publishes but is presented as unverified and does not feed attendance statistics. Circumventing or falsifying this mechanism is a serious breach of these terms.
5. What is prohibited
Prohibited, without this list being exhaustive: illegal content (hate, harassment, infringement, privacy violations, content involving minors); fake reviews, fraud against the verification mechanism and concerted complacency or denigration; spam, multiple accounts and disguised commercial use; any automated extraction or collection from the service (scraping), any unauthorized access attempt, any massive reuse of the service's content or data without written agreement. The community guidelines state the spirit of these rules.
6. Your content and your licence
Your photos, ratings and lists remain your property. By publishing them, you grant Proof a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence, for the life of the service: to host, reproduce, technically adapt (formats, thumbnails, caching), display and distribute this content within the service and the shares you choose, and to produce from the service's activity derived data, aggregated or individual, under the conditions and for the sole purposes described by the applicable privacy policy. Any advertising purpose, should it exist, will rest on your consent, collected purpose by purpose, revocable at any time without consequence on your use of the service, and will never include accounts under 18. This licence never allows us to sell your photos as such nor to use them outside the service without your agreement. The processing of your personal data is governed by the applicable privacy policy: the site's for the site and, for the app, its own, published with it and reachable from the app; they prevail over this section for everything touching personal data.
7. Moderation
We enforce these terms through user reports, human review and, where appropriate, automated detection tools. Depending on gravity and repetition: content removal, warning, feature restriction, suspension or account deletion. Every moderation decision about your content or account is notified to you with its reason, and you can contest it by replying to that notification; we then re-examine the decision. We report serious offences we become aware of to the competent authorities.
8. Reporting content
Every shot, profile or message carries a Report button in the app. You can also write to support@proofplaces.com describing the content and where it lives, or use the public platform Pharos in France. Details on the contact page.
9. Proof's property
The Proof brand, logo, interface, code and the service's databases are the property of Proof. or its licensors. No right over these elements is granted to you. Extracting or reusing a substantial part of the service's databases is prohibited (articles L.342-1 and following of the French intellectual property code).
10. Ending the account
You can delete your account at any time from Settings, without reason or notice. Two taps, and it is real: nothing is restorable, fully purging our systems and backups can take a few days, and whatever someone else copied elsewhere no longer depends on us; the detail will follow the app's privacy policy, published with it. We can suspend or delete an account for breach of these terms, with a reasoned notification and a way to contest (section 7); immediate suspension remains possible for serious breach or legal obligation.
11. Warranty, availability and liability
The service is provided without payment, but you benefit from the legal warranty of conformity for digital content and services (articles L.224-25-1 and following of the French consumer code): the service must match its description, receive the updates needed for conformity, and be brought back into conformity within a reasonable time in case of defect, on request to support@proofplaces.com. Nothing in these terms excludes that warranty nor any liability that cannot legally be excluded.
We work on the service's availability and accuracy without being able to guarantee them continuously: a maintenance interruption, an error in a place page or a route are assessed under ordinary law. Listed places are provided for information; check opening hours before heading out.
12. Third-party services
The service relies on third-party services (map tiles, place pages and photos, routes) and may link to sites or apps we do not control, subject to their own terms. These links are provided as a convenience; they imply no endorsement, and this section does not limit the liability the law imposes on us. No data is transmitted to them beyond what the privacy policy describes.
13. Inactive accounts
An account with no connection for at least two years may be deleted, with its content, in accordance with the privacy policy. You are warned in advance on the account's coordinates, with a reasonable delay to reconnect and keep it.
14. Evolution of the service and of these terms
The service evolves, free of charge in its current functions. These terms may change: any substantial change is announced in the app or by email at least fifteen days before it takes effect, and the version date at the top is authoritative. Continuing to use the service after that date means acceptance; otherwise, section 10 lets you leave freely.
15. Assignment
Proof. may assign the contract, and the licences that come with it, as part of a corporate transaction (merger, acquisition, sale of assets or business), the transferee remaining bound by these terms and by the privacy policy in force.
16. Governing law
These terms are governed by French law, without depriving a consumer of the mandatory protections of their country of habitual residence. Any claim is handled first at support@proofplaces.com; failing an amicable agreement, you may resort to consumer mediation under the French consumer code (the appointed mediator will be indicated on this page), then to the competent courts under ordinary law. If a paid offer ever exists, dedicated terms of sale will complement these.
17. Miscellaneous
Survival. Stipulations meant to last (intellectual property, licences already granted to the extent necessary to the service and to produced aggregates, liability, evidence, governing law) survive the end of the account.
Partial invalidity. If a stipulation is held invalid, the others remain in force; the invalid one is replaced by the legal rule closest to its purpose.
No waiver. Not exercising a right immediately, for you as for us, does not waive exercising it later.
Evidence. The service's technical logs, timestamps, acceptance records and notifications are admissible evidence between us until proven otherwise.
Notices. We notify you in the app or by email at the account's coordinates; you notify us at support@proofplaces.com or by post at Proof., 47 rue Vivienne, 75002 Paris.
Force majeure. Neither party is liable for a failure caused by an event beyond its reasonable control within the meaning of article 1218 of the French civil code; an ordinary outage or a maintenance defect is not one.
Language. These terms are written in French; in case of translation, the French version prevails.
